Terms and Conditions

Welcome to Elegant Rentals. We are committed to providing a premium vehicle hire experience with professionalism, transparency, and exceptional service. These Terms and Conditions govern all bookings, rentals, and use of vehicles supplied by Elegant Rentals. By making a booking, paying any amount toward a booking, or taking possession of a vehicle, you agree to these Terms and Conditions.

1. Definitions

In these Terms and Conditions:

Elegant Rentals, we, us, and our means Elegant Rentals.
Renter, you, and your means the person making the booking and/or entering into the rental agreement.
Vehicle means any car supplied by Elegant Rentals.
Booking means the reservation made by you for a vehicle and rental period.
Rental Period means the agreed period of hire shown in your booking confirmation or rental agreement.
Agreement means these Terms and Conditions together with any booking confirmation, invoice, vehicle condition report, waiver, or signed rental document.

2. Booking Acceptance

All bookings are subject to availability and acceptance by Elegant Rentals.
A booking is only confirmed once we issue written confirmation.
We reserve the right to decline any booking at our discretion, subject to applicable law.
Pricing, inclusions, and vehicle availability may change until the booking has been confirmed.

3. Eligibility to Hire

To hire a vehicle from Elegant Rentals, you must:

hold a valid driver’s licence suitable for the class of vehicle being hired;
provide valid photo identification upon request;
meet our minimum driver age requirements;
provide a valid payment method in your name;
be legally permitted to drive in New South Wales and Australia.

If your driver’s licence is issued in a language other than English, we may require an International Driving Permit or an official English translation.

4. Payments, Deposits, and Security Bond

Full payment or a deposit may be required at the time of booking.
A security bond may also be required before the commencement of the rental period.
The amount of any bond, deposit, or pre-authorisation will be advised prior to vehicle handover.
We may apply the bond toward any unpaid charges, loss, damage, tolls, infringements, cleaning fees, refuelling costs, or other amounts owed under this Agreement.
Any remaining balance of the bond will be released after the vehicle has been inspected and all outstanding charges have been finalised.

5. Cancellation and Refund Policy

Cancellations made more than 48 hours before the booking start time may be eligible for a refund, less any non-refundable fees or charges disclosed at the time of booking.
No refunds will be provided for cancellations made within 48 hours of the booking start time.
If you fail to collect the vehicle, arrive late, shorten your hire, or otherwise do not use part or all of the booked rental period, no refund will be payable within 48 hours of the booking start time.
If Elegant Rentals is unable to provide the booked vehicle due to reasons within our control, we may offer a suitable substitute vehicle or provide a refund, as required by law.
Any exception to this cancellation policy is at our sole discretion, unless otherwise required by applicable law.

6. Vehicle Collection and Return

Vehicles must be collected and returned at the agreed date, time, and location.
You must inspect the vehicle at the commencement of the rental and notify us of any pre-existing damage not already recorded.
The vehicle must be returned in the same condition in which it was supplied, fair wear and tear excepted.
Late returns may incur additional rental charges and other applicable fees.
Vehicles returned excessively dirty may incur cleaning or detailing charges.
Smoking or vaping in the vehicle is strictly prohibited.

7. Use of Vehicle

You must not use, or allow the vehicle to be used:

by any person not authorised by Elegant Rentals;
for any unlawful purpose;
while the driver is under the influence of alcohol, drugs, or any substance affecting driving ability;
in a reckless, dangerous, abusive, or negligent manner;
for racing, burnouts, drifting, track days, speed testing, or driver training;
off-road or on unsuitable terrain;
to carry more passengers than legally permitted;
to tow another vehicle or trailer unless approved by us in writing;
to transport dangerous, prohibited, or illegal goods;
outside any approved geographic area without our prior written consent.

8. Authorised Drivers

Only drivers approved by Elegant Rentals may drive the vehicle.
Additional drivers must provide all requested identification and licence documentation.
The renter remains fully responsible for the vehicle and for compliance with this Agreement at all times.

9. Damage, Loss, and Responsibility

You are responsible for the vehicle during the rental period.
You must take reasonable care to protect, secure, and maintain the vehicle.
You must notify us immediately of any damage, accident, theft, warning light, fault, or issue affecting the vehicle.
You must not arrange or authorise repairs without our prior approval, unless immediate action is reasonably necessary for safety.
Subject to any applicable insurance arrangement and to the extent permitted by law, you may be liable for repair costs, recovery costs, loss of use, towing, storage, diminished value, administration costs, and any related losses arising from damage or breach of this Agreement.

10. Accidents and Incidents

If the vehicle is involved in an accident, theft, attempted theft, damage event, or other incident, you must:

notify Elegant Rentals immediately or as soon as reasonably possible;
report the incident to police where required by law;
obtain the names, addresses, contact details, licence details, and registration numbers of all involved persons and vehicles;
not admit liability;
provide us with a full written report and any photos, dashcam footage, or other supporting evidence available;
cooperate fully with any investigation or insurance process.

11. Tolls, Fines, and Infringements

You are responsible for all tolls, parking fees, fines, traffic infringements, penalties, impound fees, and related charges incurred during the rental period.
Where we are required to process, recover, or reissue these charges to you, they may be invoiced to you.
A one-off administration fee of $15 per invoice will apply to each invoice issued in relation to tolls, fines, infringements, penalties, or similar charges.
We may charge these amounts to your nominated payment method, to the extent permitted by law.

12. Fuel, Charging, and Refuelling Costs

Fuel vehicles must be returned with the same fuel level provided at handover, unless otherwise agreed in writing.
Electric or hybrid vehicles must be returned with the agreed battery charge level.
If the vehicle is returned with less fuel or charge than required, we may issue an invoice for the shortfall, the service cost, and any applicable recharge or refuelling amount.
A one-off administration fee of $15 per invoice will apply to each invoice issued for refuelling, recharge shortfall, or related servicing costs.

13. Breakdown and Mechanical Issues

You must notify us immediately if the vehicle develops any warning light, fault, or mechanical issue.
You must stop driving the vehicle if continuing to drive may cause damage or create a safety risk.
We will provide reasonable assistance in the event of a mechanical issue, subject to the cause of the problem.
You may be responsible for costs arising from misuse, negligence, or failure to follow our instructions.

14. Insurance and Liability

Any insurance cover, exclusions, and excess amounts will be set out separately in your booking confirmation or rental agreement.
Nothing in this Agreement excludes, restricts, or modifies any rights you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
To the maximum extent permitted by law, Elegant Rentals is not liable for indirect, incidental, special, or consequential loss, including loss of enjoyment, missed events, accommodation costs, lost profits, or alternative transport expenses.
We are not responsible for loss of or damage to personal items left in the vehicle.

15. Roadside Assistance

Roadside assistance may be available subject to separate provider terms and conditions.
Fees may apply where roadside assistance is required due to renter fault, including flat batteries caused by user error, lost keys, lockouts, tyre damage, or incorrect fuel use.

16. Right to Refuse, Suspend, or Cancel

We reserve the right to refuse, suspend, or cancel any booking or rental where:

you do not satisfy our identification, payment, or licensing requirements;
payment is declined or reversed;
we reasonably believe the vehicle may be misused or placed at risk;
there is a legal, safety, operational, or reputational concern;
the vehicle becomes unavailable due to prior damage, breakdown, delayed return, or circumstances beyond our reasonable control.

Any refund in these circumstances will be handled in accordance with applicable law.

17. Cleaning, Smoking, and Presentation

All vehicles must be returned in a clean and respectable condition.
Additional cleaning, detailing, stain removal, odour removal, or sanitisation charges may apply where the vehicle is returned in an excessively dirty condition.
Smoking and vaping are strictly prohibited in all vehicles and may result in specialist cleaning charges.

18. Personal Property

Any personal property left in the vehicle is at your own risk. To the extent permitted by law, Elegant Rentals is not responsible for any lost, stolen, or damaged personal belongings left in or transported in the vehicle.

19. Privacy

We may collect, use, and disclose your personal information for booking administration, identity verification, payment processing, insurance, legal compliance, toll and infringement processing, and customer service.
We may disclose information to payment providers, insurers, toll operators, government authorities, legal advisers, debt recovery agencies, and service providers where reasonably necessary.
Our handling of personal information is also subject to our Privacy Policy.

20. Website Content and Vehicle Images

We take reasonable care to ensure that information on our website is accurate; however, errors, omissions, or updates may occur from time to time.
Vehicle images are for general illustration only and may not exactly reflect the vehicle supplied.
We reserve the right to correct any pricing, listing, or availability error before confirming a booking.

21. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising in connection with these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales.

22. Amendments

We may update these Terms and Conditions from time to time. The version published on our website at the time of your booking will apply, unless otherwise required by law.

23. Credit Card Chargebacks and Payment Disputes

The Customer must not make, initiate, or pursue any unjustified credit card chargeback, payment reversal, or other payment dispute in relation to any amount properly charged by Elegant Rentals under these Terms and Conditions.

In the event of any billing dispute, the Customer must promptly notify Elegant Rentals in writing and provide all relevant particulars, and the parties must use reasonable efforts to resolve the matter in good faith before any chargeback or reversal is initiated.

Elegant Rentals reserves the right to contest any chargeback or payment reversal by providing to its payment processor, financial institution, or merchant services provider any information or documentation reasonably required to substantiate the transaction, including but not limited to quotations, invoices, booking confirmations, signed agreements, delivery records, collection records, photographs, correspondence, and evidence of services supplied.

If a chargeback or payment reversal is found to be unfounded or is otherwise resolved in favour of Elegant Rentals, the Customer shall be liable for the original amount charged together with any merchant fees, administrative costs, recovery costs, and any other reasonable expenses incurred by Elegant Rentals in connection with the dispute.

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights or remedies the Customer may have under the Australian Consumer Law or any other applicable law.

24.Pets

Pets are permitted in Elegant Rentals vehicles only with the prior approval of Elegant Rentals. The Customer must ensure that any pet transported in the vehicle is properly restrained, secured, and supervised at all times in accordance with all applicable laws and safety requirements.

The Customer is responsible for ensuring that the vehicle is returned in a clean and sanitary condition following any transport of pets. If the vehicle is returned with pet hair, odour, stains, soiling, or any other condition requiring additional cleaning or deodorising, Elegant Rentals reserves the right to charge the Customer reasonable cleaning and detailing fees.

The Customer remains fully responsible for any loss or damage caused by a pet to the vehicle, including but not limited to damage to seats, trims, carpets, doors, fittings, or interior surfaces, and Elegant Rentals may recover the cost of repair, cleaning, or replacement from the Customer.

25.Security Bond

A security bond starting from $2,000 is payable before the commencement of the hire. The applicable bond amount will be as stated in the advertisement, booking confirmation, or otherwise advised by Elegant Rentals.

Elegant Rentals may apply the bond toward any amount owing under these Terms and Conditions, including unpaid hire fees, damage, cleaning, late return fees, tolls, fines, or other related charges. Any remaining balance will be refunded within a reasonable time after the vehicle is returned, inspected, and all outstanding charges have been finalised.
